‘Cases of Hindu sides maintainable’: Allahabad High Court dismisses Muslim side’s petition on Mathura temple-mosque dispute.

Upendra Bharti | HENB | Prayag Raj | Aug 1, 2024:: In the matter of contentious Krishna Janmabhoomi and Shahi Eidgah dispute at Mathura, the Allahabad High Court on Thursday dismissed the application of Muslim side challenging maintainability of  suits filed by Hindu sides seeking restoration of Lord Krishna temple at the place where Shahid Eidgah Masjid exists.

Justice Mayank Kumar Jain said that suits of Hindu plaintiffs are not barred by any law including Places of Worship Act, which bars conversion of a religious place as existed on August 15,1947.

The suits have been filed for possession after removal of structure of Shahi Eigah masjid as well as for restoration of temple and for permanent injunction.

The controversy is related to Mughal emperor Aurangazebera Shahi Eidgah mosque at Mathura, which is alleged to have been built after demolishing a temple at the birthplace of Lord Krishna.

On today’s court order on Shri Krishna Janmabhoomi-Shahi Idgah case, the secretary of Janmasthan, Kapil Sharma, said that after a long wait, the Hindu side has won the first step in this case. Lord Krishna will continue to bless us like this and soon the decision will come in favour of Janmabhoomi. He said that the decision of the High Court is welcome. If the opposition goes to the Supreme Court against this order, then a suitable reply will be filed there too through our advocate. Along with this, a caveat will also be filed, so that the Supreme Court also hears the Janmabhoomi side before giving any decision.

Understanding the story of the entire dispute at a glance

18 cases have been filed so far in the Sri Krishna Janmasthan-Idgah dispute. On 25 September 2020, the first case was filed by Lucknow-based advocate Ranjana Agnihotri in the court of Civil Judge Senior Division, Mathura. In this, a demand was made to cancel the agreement made in 1968 between Shahi Masjid Idgah Committee and Sri Krishna Janmasthan Seva Sangh. On 25 September 2020, the court dismissed Ranjana Agnihotri’s case and said that she does not have the right to file a case. An appeal was made in the court of District Judge on 15 October 2020. On 15 December 2020, Manish Yadav, President Narayani Sena filed a case.

On 23 December 2020, Mahendra Pratap, President of Sri Krishna Janmabhoomi Mukti Nyas, filed a suit, which was the first suit accepted for hearing by the court. On 2 February 2021, Pawan Kumar Shastri, Sevayat, Ancient Keshavdev Temple filed a suit. On 20 February 2021, Shailendra Singh filed a suit. On 2 March 2021, Hindu leader Dinesh Chandra Sharma filed a suit. On 31 March 2021, Anil Kumar Tripathi filed a suit. On 7 September 2021, Jitendra Singh Visen filed a suit. On 24 September 2021, Gopal Giri Maharaj filed a suit.

On 8 December 2022, Vishnu Gupta, National President Hindu Sena filed a suit. On 23 December 2022, Mahendra Pratap Singh filed a second suit claiming that the idol was buried in the stairs of Jama Masjid in Agra. On 2 January 2023, Ashutosh Pandey filed a suit. On 12 April 2023, Ajay Pratap Singh filed a suit. On 22 May 2023, Naresh Yadav filed a suit. On 23 May 2023, Harishankar Jain filed a suit. On 10 August 2023, Surendra Gupta filed a suit. On 11 August 2023, Omprakash Singhal filed a suit. On 26 May 2023, Allahabad High Court ordered to transfer all the cases related to Shri Krishna Janmabhoomi from the Sessions Court to the High Court. On 20 March 2024, Virendra Singh and Thakur Vijay Kumar Singh of Kaushambi Tewan filed a suit.

Today the bench of Justice Mayank Kumar Jain in Allahabad High Court declared the maintainability of all these 18 cases filed by Hindu sides to the liberate the Sri Krishna Janmabhoomi for the purpose of restoration, renovation, construction of the magnificent temple of Lord Krishna.

Taking to the media persons, Advocate Vishnu Shankar Jain describes today’s court order as a ‘big shock to the Muslim sides’. He also divulges that the Hindu sides will file a Caveat to the Supreme Court of India along with filing a petition in appropriate Court of law for Scientific Survey in Krishna Janmabhoomi by ASI (Archaeological Survey of India).

The next hearing of the case in Allahabad High Court is fixed on August 12, as reported.
