Upendra Bharti | HENB | New Delgi | Dec 6, 2025:: The Hindu Sena, led by national president Vishnu Gupta, has filed a petition in the Ajmer District Court seeking a ban on the practice of offering chaddar (decorative cloth) to the Ajmer Sharif Dargah by Prime Minister Narendra Modi and other constitutional personalities. The petition was filed on December 5, 2025, and was heard by Judge Manmohan Chandel, who issued a notice to the Ministry of Minority Affairs, Government of India.
Case Background
The petition claims that the Dargah is built on the remains of an ancient Shiva temple, Bhagwan Shri Sankatmochan Mahadev Virajman, and the case is currently pending in the court to determine the nature of the site. The Hindu Sena argues that the practice of offering chaddar, which was started by former Prime Minister Jawaharlal Nehru as a form of appeasement towards Muslims, should be stopped until the case is resolved.
Court’s Response
The court has scheduled the next hearing for December 10 and has asked the Ministry of Minority Affairs to respond to the petition. This application is filed by the plaintiff with the intention of restraining defendant number 2 (Ministry of Minority Affairs) from offering a chaddar (shawl) at the Dargah until the aforementioned case is pending in this court.
That the hearing in the said case before the Hon’ble Court is scheduled for the next date, 03.01.2026.1. That, as per the averments in the plaint, Lord Mahadev, in the form of an extremely ancient idol, is enshrined beneath the so-called Dargah on the disputed property, and even after the ancient magnificent temple was partially damaged and defaced by foreign invaders, and mythical and misleading stories were propagated as history, there is evidence of underground temple chambers. The entire building structure and artwork are also based on the construction style of other Rajputana buildings.
Prima Facie Injury
2. That the offering of a chaddar at the Dargah by defendant number 2, either personally or through a constitutional office (such as the Prime Minister), appears to be a prima facie infringement and prejudice to the rights of the plaintiff, contrary to the spirit of the case pending in the Hon’ble Court.
Irreparable Loss
That the news of the chaddar offered by defendant number 2, either personally or through a constitutional office, at the so-called Dargah site, is being propagated by the defendant as evidence to reinforce their illegal claim over the disputed property. As a result of the resulting misconception, the continuous concealment of the fact that Lord Mahadev has been enshrined there since ancient times, beyond archaeological significance, appears to be a permanent legal injury to the rights of the plaintiff, and gives credence to the misconception among the general public, thus giving rise to the apprehension of irreparable loss. The practice of offering a sheet (chadar) at the dargah is also novel and fictitious.
3. That neither in the Sufi tradition, nor in Islamic beliefs, nor in contemporary history written by Islamic invaders, nor in any ancient Islamic practice is there any mention of offering a sheet at the site of the so-called dargah.
Balance of Convenience
4. That during the judicial process of hearing the case, despite the absence of any Islamic or ancient tradition, the act of respondent no. 2, either personally or through a person holding a constitutional office (such as the Prime Minister), offering a sheet, provides constitutional sanction to such superstition and attempts to suppress the fact of Lord Shiva being present there. This causes damage to the rights of the plaintiff, and therefore, the balance of convenience also appears to be in favor of the plaintiff.
5. In this regard, the humble plaintiff has previously and again this year submitted a memorandum to the Honorable Prime Minister expressing his objection.
Prayer
The humble plaintiff respectfully prays to the Honorable Court to observe that all three essential conditions for an injunction are fulfilled in the above context, and to kindly issue an order of temporary injunction restraining respondent number 2 from offering a sheet, either personally or through any person holding a constitutional office, while the case is pending.
