Hindu Sena Urges Centre to Enact Nationwide ‘Disturbed Areas Act’ to Address Alleged Forced Migration of Hindus.

Upananda Brahmachari | HENB | New Delhi |  March 10, 2026:: Raising concerns over what it describes as the “systematic migration” of Hindus from certain parts of the country, the Hindu Sena has submitted a memorandum to the Union Home Secretary urging the Central Government to introduce a nationwide “Disturbed Areas Act.” The organization argues that such legislation is necessary to prevent alleged forced property sales and demographic shifts in sensitive regions. Unfortunately, forced migration of Hindus from Muslim-dominant areas has become a grave concern in India even 79 years after Independence. Hindus are also subjected to forced migration in Christian-majority states in Northeast India.

According to the memorandum, the group has requested the Ministry of Home Affairs (MHA) to draft and introduce a Central Disturbed Areas Bill in Parliament. The proposed law would be modeled on similar provisions already implemented in Gujarat and recently passed in Rajasthan, where authorities can regulate property transactions in areas notified as “disturbed” to prevent coercion or distress sales.

Concerns Over Migration and Demographic Change

The Hindu Sena claims that migration of Hindus from mixed-population or Muslim-majority localities in several states has become a significant social issue decades after India’s independence. The organization argues that such movements are not merely routine demographic shifts but may be the result of security concerns and social pressure faced by residents.

In a statement accompanying the memorandum, Vishnu Gupta, National President of Hindu Sena, said that members of the Hindu community in several regions feel increasingly vulnerable.

“Today, in several states including West Bengal, Uttar Pradesh, Jammu & Kashmir, Mewat in Haryana, Madhya Pradesh, and Maharashtra, the Hindu community is living in an environment of deep insecurity,” Gupta said. “In some areas, radical elements and illegal immigrants are allegedly creating conditions that compel Hindu families to sell their properties at low prices and relocate.”

He also noted that such concerns have been reported even in states governed by the Bharatiya Janata Party (BJP), including Haryana, Madhya Pradesh, and Maharashtra, where, according to the organization, Hindus in certain localities continue to feel vulnerable.

Key Points in the Memorandum

In its press note, the Hindu Sena outlined several arguments in favor of a nationwide “Disturbed Areas Act”:

1. Alleged Planned Migration
The organization claims that the movement of Hindu families from mixed or Muslim-majority neighborhoods in some regions appears to be a coordinated pattern rather than a voluntary demographic change.

2. Protection of Property Rights
Under a “Disturbed Areas Act,” property transactions in notified areas would require prior government approval. Supporters of such laws argue that this mechanism can help prevent coerced or distress sales, ensuring that property transfers occur voluntarily and transparently.

3. Measures Against Illegal Infiltration
The memorandum also calls for stronger action against illegal immigration, alleging that some sensitive areas have become safe havens for undocumented migrants, including Rohingya refugees and Bangladeshi nationals.

4. A Proposed National Framework
The Hindu Sena pointed to the Gujarat Disturbed Areas Act, which regulates property transfers in communally sensitive zones, and the recently passed legislation in Rajasthan, as potential models for a nationwide framework. The organization claims such policies could help maintain social balance and communal harmony.

Call for Central Legislation

The group has urged the Union Home Ministry to consider drafting a central law applicable across India, arguing that a unified approach would provide stronger protection in regions where communal tensions and demographic anxieties are perceived to be increasing.

According to the memorandum, early legislative intervention would help prevent further social polarization and protect the cultural and residential rights of communities in vulnerable areas.

Broader Context

Debates over demographic change, migration patterns, and property rights in communally sensitive areas have periodically surfaced in Indian politics and policy discussions. Laws regulating property transfers in “disturbed areas” have been defended by some as tools to prevent coercion and communal pressure, while critics have argued that such laws could potentially affect freedom of property transactions and residential mobility.

As of now, the Ministry of Home Affairs has not publicly responded to the Hindu Sena’s memorandum.
