Upananda Brahmachari | HENB | New Delhi | March 15, 2016:: A Public Interest Litigation (PIL) has been filed against All India Majlis-e-Ittehadul Muslimeen (AIMIM) Chief Asaduddin Owaisi in Allahbad High Court on Tuesday over his speech in which he said that he will not chant ‘Bharat Mata ki Jai, saying ‘even someone keeps knife on my throat ’.
The PIL has been filed under IPC Section 124A (charge of sedition) against him.
When he was asked about it, Owaisi said that he had full faith in the legal system and that the court will do justice and finished his statement saying ‘Jai Hind’. (“Mujhe Court par poora yakeen hai. Court insaaf karega, Koi case nahin hai, Jai Hind!”).
Actually, communal insanity invaded the mind of this AIMIM Chief. He and his brother Akbaruddin Owaisi are infamous for their anti-Hindu and anti-National stand which usually spark the debate as they want to provoke the majority AIMIM supporters against the majority people of India.
The All India Majlis-e-Ittehadul Muslimeen (AIMIM) president stirred a row on Sunday by making contentious remarks against the slogan of Bharat Mata ki Jai. Addressing a gathering of party worker and supporters in Latur, Owaisi had said, “I will not chant that slogan. I will not say Bharat Mata ki Jai. What will you do? I won’t utter that (slogan) even if you put a knife to my throat.” He was replying to the public appeal made by Rashtriya Swayamsevak Sangh (RSS) chief Mohan Bhagwat, demanding that new generation all around the nation should be taught to say Bharat Mata ki Jai.
Though patriotic people of great reputation like Javed Akhtar and Najma Heptulla (both belonging to Muslim community) condemned the ill-mentality of Asaduddin Owaisi and upheld the practice of chanting ‘Bharat Mata ki Jai’, the lone and insane AIMIM RS MP did not detract from his aversion to say Hail Mother India!
We know that Asaduddin is a Barrister-at-Law (Lincoln’s Inn), but perhaps he possesses less judicious mind or otherwise built up a mind to misinterpret the law of the land with an acute mala fide intention.
Facing a furor, Asaduddin questioned, ‘What law would be violated if I won’t say Bharat mata ki jai?’
For his kind information, if he wants to humiliate by saying, ‘ I’ll not say Bharat Mata ki Jai’, it will be a case for violating Art. 51A of Indian Constitution with attracting the IPC 124A also.
Asauddin must keep in his mind the statute of Vande Mataram or Bharat Mata ki Jai under framed law and Bharat Mata ki Jai is as equal as Vande Mataram. Asaduddin and some of such like-minded fellow have a very bad intention to attack the Vande Mataram or Bharat Mata ki Jai with a regular interval.
The national song of India, Vande Mataram holds the constitutional status of national song considering its immense contribution in India’s freedom movement. It has the same status as the national anthem Jana Gana Mana holds.
Vande Mataram had become an expression of nationalism for the patriots and revolutionaries who launched several movements and agitations against the oppressive British Rule drawing inspiration from the magic words of Vande Mataram song. In fact, Vande Mataram had become a symbol of India’s freedom struggle. Great exponent of India classical music Pandit Vishnu Digambar Paluskar played an important role in popularizing Vande Mataram during freedom movement. He began public recitation of Vande Mataram from Lahore and sung it at many places all over the country. His presentation of Vande Mataram was so charged with emotions that it used to thrill the listeners and arouse feelings of nationalism among them making them feel proud of the mother nation.
The Vande Mataram is sung in the Parliament and various State Assemblies. There are different regulations to recite Vande Mataram in Indian Parilament and many state assemblies.
Rajendra Prasad, who was presiding the Constituent Assembly on 24 January 1950, made the following statement which was also adopted as the final decision on the issue:
…The composition consisting of words and music known as Jana Gana Mana is the National Anthem of India, subject to such alterations as the Government may authorise as occasion arises, and the song Vande Mataram, which has played a historic part in the struggle for Indian freedom, shall be honoured equally with Jana Gana Mana and shall have equal status with it. (Applause) I hope this will satisfy members. (—Constituent Assembly of India, Vol. XII, 24-1-1950)
Orders issued by the Department of General Administration refer to the Article 51-A that it would be “to cherish and follow the noble ideals which inspired our national struggle for freedom”. As Vande Mataram and Bharat Mata ki jai are same and inspired our struggle for freedom, we can not say we will not chant these. These tendency is simply violation to the Art. 51-A (b), under Fundamental duties of any Indian citizen. So, Asaduddin must be drawn under law enforcement upon this point.
Again, Asaduddin hit the temple of Indian integrity by his culpable speech.
In citizens’ fundamental duties it is said in the same Article 51-A of Indian Constitution,
(c) to uphold and protect the sovereignty, unity and integrity of India;
(d) to defend the country and render national service when called upon to do so;
But, with such impression of his saying, will never say Bharat Mata ki Jai, Asaduddin challenged the integrity of India through his utter hostility against the Nation and its protective wings of Army which maintains, “Bolo Bharat Mata Ki Jai” (Say Victory to India).
I would like to say my badly learned friend Asaduddin what he will do if he is called in any urgency for Mahar Regiment which has its war-cry, “Bolo Bharat Mata Ki Jai”.
Sorry to say, Mr. Asaduddin Owaisi still carries the same Rajakar tradition (for a few communal people) of Hyderabad for which they once rebelled against Independent India and wanted to take the line with Pakistan.
These men like Asaduddin Owasi with ill intellect are more dangerous than any persons with arms and ammunition and posing greater threat to the Nation and National security. They must be put under Jail under National Security Act and strictly dealt with.
Jihad against Vande Mataram or Bharat Mata ki Jai must be evaded forthwith under a stringent strangulation.
