No Religion Prescribes Use Of Loudspeakers For Prayer: Allahabad HC Declines Mosques’ Request To Install Loudspeaker For Five Time Azaan.

Upananda Brahmachari | HENB | Allahabad | January 21, 2020:: The Allahabad High Court has said that the ban as imposed by a SDM for mounting loudspeakers and amplifiers in  mosque in a village in Uttar Pradesh, will not be lifted. The court ordered that the SDM (Sub Divisional Magistrate)’s direction will not be interfered anyway with the exercise of its jurisdiction of court of law.
The court said that the cancellation of the SDM’s order could damage the social balance. The SDM earlier ordered to stop use of loud speaker of a Mosque for controlling disputes and tensions prevailed between the Hindus and Muslims in that locality in Jaunpur in Uttar Pradesh.
The SDM stopped the use of sound amplifier in Masjid Abu Bakar Siddiqui and Masjid Rahmani at in village Baddopur, Tehsil Shahganj, District Jaunpur for the purposes of Azaan for Namaz at the end of July 2018 onward, as there was no valid permission to use of sound amplifiers and loud speakers by Mosques and some tension was created in those areas from the use of loud speakers of Mosques.
Aggrieved Muslims attached to Mosque committees appealed in Allahabad High Court (WRIT – C No. – 43167 of 2019) after their earlier plea (Writ Petition (C) No.11840 of 2018) was rejected in the Court of law.
Those who filed the petition stated that they should be allowed to play loudspeakers at the mosque for two minutes for five-time prayer (namaj) daily. They claimed that this would not harm pollution and social order. This is part of their religious work. As the population is increasing day by day, and it is important for Muslims to raise a prayer call through loudspeakers before prayers.
Rejecting this demand, Judge Pankaj Mittal and Judge Bipin Chandra Dikshit said that according to Article 25 (1) of the Constitution, all citizens are allowed to practice and promote their religion. But, there is no mention to use loudspeakers for any prayer call in any religious books, so far. On the other hand, the priority of the High Court is to apply the law properly to maintain the harmony of the society maintaining proper order to ensure ‘social interest and public good’. And in the present case, it is clear that there is no need for evangelism in the society, rather it is very much important to maintain social cohesion.
