Upananda Brahmachari | HENB | Bangalore | June 20, 2018:: The Special Investigation Team (SIT) as framed for Gauri Lankesh Murder is now acting like an anti-Hindu Agency as the activities of SIT are highly opposed and condemned by many legal forums, viewing the its unlawful advancement to implicate the Hindu activists in utmost oppressive way.
Taking the cognizance on the allegation of such ‘Torture on Hindu activists’ accused for Gauri Lankesh murder and thier alleged ‘kidnapping. by SIT prior to the arrest of the accused, the Karnataka High Court sought reports ‘police torture’ of accused.
The Karnataka High Court has directed two magistrate courts here to submit a report on allegations of custodial torture of four accused in the Gauri Lankesh murder case and non-compliance of judicial procedures.
The allegations are “serious in nature” and the Registry of the High Court has been directed to communicate the order to the magistrates of the first and third additional chief metropolitan magistrate (ACMM) courts, Justice K N Phaneendra said when the matter came up for hearing yesterday.
“They should submit a report on the allegations within 10 days from the date of receipt of this order,” he said.
In an affidavit, advocate N P Amrutesh alleged that Amol Kale, one of the accused in the case, was beaten, slapped and punched on his cheek by police officers while in custody.
The magistrates also failed to comply with procedures mandated by the Supreme Court regarding persons in police custody, he claimed.
The advocate is representing Kale, Sujith Kumar, Amit Ramachandra Degvekar and Manohar Edave, arrested in connection with the killing of the veteran journalist.
The counsel for the accused also alleged that the magistrate did not order a medical examination even after being informed on June 14 about the torture meted out to one of the accused by the police.
“Instead, the magistrate only recorded injury marks on his body,” he said.
The counsel further said similar complaints regarding custodial torture of the other accused were also made on May 31 before the magistrate of the third ACMM, which was neglected.
Hence, he prayed for a court direction to authorities concerned to conduct a medical examination of the accused and a probe into their illegal detention and torture by the police.
He also sought Rs 25 lakh as compensation for each of the accused, besides a direction to the magistrate to record their statements in in-camera proceedings.
On June 12, the high court had issued notices to the Karnataka government, state police chief and police officials concerned in the matters.
It had also directed the police to ensure that the accused were not ill-treated.
Gauri Lankesh, a Left-leaning journalist and a strong Hindutva critic, was shot-dead from a close range by motorcycle-borne assailants in front of her house on September 5 last year.
The accused, who have been arrested in the Gauri Lankesh murder case, were “kidnapped” by the police before they were shown arrested, charged advocate Virendra Ichalkaranjikar, president of ‘Hindu Vidhidnya Parishada’ (HVP), who is assisting the accused with legal aid.
Speaking to Deccan Chronicle, Virendra charged the Special Investigation Team (SIT) of “kidnapping” the accused Sujeet alias Praveen (37) an alleged Hindu Janjagruti Samiti (HJS) activist from Mangaluru, Amol Kale alias Bhaisab, 39, also an alleged HJS activist from Pune, Amit Degwekar alias Pradeep, 39, a Sanatan Sanstha activist and resident of Goa, and Manohar Edave, 28, a resident of Vijayapura in Karnataka.
“All these men were illegally detained by the SIT much before their arrest was shown. Sujeet was picked up from coastal Karnataka on May 6, but his arrest was shown from Kolar on May 20. Amol and Amit were detained in Kagal in Kolhapur district on Maharashtra-Karnataka border on May 14. Edave was picked up from Kolhapur the same day, but the arrest of the three was shown on May 20 and 21 in Bengaluru. They were in illegal custody of the SIT before their arrest,” alleged Ichalkaranjikar.
He said, “The Karnataka SIT is working on the same lines as the Maharashtra Anti-Terrorist Squad (ATS), which during its investigation of the 2008 Malegaon blast case had illegally detained Sadhvai Pragya and Sudhakar Chaturvedi before showing their arrest.”
He alleged that the SIT has “foisted” false cases the conspiracy to eliminate writer K.S. Bhagawan and Gauri murder on the accused as an “excuse” to extend their police custody. “After the Bhagawan
conspiracy, now they are saying that they could be involved in the murder of Prof M.M. Kalburgi. The SIT has held the accused in illegal and legal custody for so long that by now they should have extracted all information from them and solved the the Gauri murder case if they were really involved. The initial FIR, which was registered against them in Upparpete police station in the Bhagawan conspiracy case under the Arms Act case was a ploy by the police to extend the police custody. The case is bogus,” he said.
Meanwhile, Chetan Rajhans, spokesperson of ‘Sanatan Sanstha,’ which is under the scanner, said that barring Amit Degwekar, who was the promoter of ‘Sanatan Prabhat’ – the SS magazine – none of the other accused were linked to the organisation. “Degwekar is a promoter of ‘Sanatan Prabhat’ and he used to tour a lot for its promotion. He used to come to the ashram in Ponda, in South Goa in connection with his work. The Sanstha is involved in the spiritual enhancement of Hindus. We are not killers. There is no connection between the Sanatan Sanstha and Gauri murder. We didn’t know her. It is a political conspiracy to target the Sanatan Sanstha.”
“The Sanstha is blamed for the murder of any atheist or Communist in the country because our presence affects their functioning and business. Gauri was an atheist and she was killed when Siddaramaiah, who is an atheist, was the chief minister. It’s high time the main players behind the conspiracy to tarnish the Sanstha are exposed,” said Rajhans. In an press meet in Panji Goa on 7th June, Rajhans narrated Sanatan Sanstha as a ‘soft target’ for the probe agencies and that’s why SIT and other probe agencies always targeting the ‘nirdosh sadhaks’ (innocent aspirants) in Gauri Lankesh murder.
Actually, the lobby to implicate the Hindu activists in some angle of so-called “Saffron Terrorism” is not stopped in the bureaucrats and operatives in SIT or elsewhere in Administration and Police departments.
In earlier cases the different SIT, TADA, other probe agencies or some fast track courts related these agencies harassed, persecuted and posed as life threats for many Hindu saints, activists, supporters of Hindutva as seen in the Malegaon or Samjhoita blasts. Two veteran saints like Swami Aseemananda Ji and Sadhvi Pargya Singh Thakur was wrongly detained in the jail over years and tortured there in unbelievable and inhuman ways.
In the same ‘anti-Hindu’ line of action the present SIT and other probe agencies under present Modi Govt are doing the same torture and injustice to the Hindu activists as those did under earlier regime of Congressi Govt.
This anti-Hindu activism by various probe agencies and police must be stopped to save the devout activists connected with Hindutva movements.
