B Upendran | HENB | Chennai | Dec 3, 2022:: Veteran BJP leader and former Union Minister and Rajya Sabha MP  Dr Subramanian  Swamy asked Tamil Nadu Chief Minister M.K. Stalin to free all Hindu temples and institutions from government control as per the Supreme Court verdict. 

As per report, Dr Swamy has said in a letter sent to the Chief Minister yesterday: Keeping Hindu temples and institutions in Tamil Nadu under the control of the Hindu Religion and Charities Endowment Department for many years is against Articles 25 and 26 of the Constitution of India. 

In one of the cases I pursued in the Supreme Court, the Government of Tamil Nadu was the respondent. The verdict in that case was released in 2014. It states that ‘Government should not conduct religious ceremonies in temples. It has been said that if there are any financial irregularities or financial problems in the temples, the government can take control for a certain period of time to solve them.

Accordingly, respecting the Supreme Court order, all Hindu temples and institutions controlled by the state government should be released. Otherwise, I will file a contempt of court case against the Tamil Nadu government. This is stated in the letter.

The Hindu Religion and Charities Endowment Act (HR&CE Act, 1959) under which the Tamil Nadu Govt controls the Hindu temples has many disparities with the Agama Shastras as reported. 

As per a report, TN Govt held a meeting in January this year to amend the HR&CE Act for removing the anomalies with Hindu  Agama Shastras  found in  the said Act.
