Government must address injustices against Hindus still remain in Waqf Amendment Bill: HJS.

Waqf Amendment Bill is incomplete; Government must address injustices against Hindus! – Hindu Janajagruti Samiti.

Upananda Brahmachari | HENB | Haridwar | April 4, 2025:: The Unified Waqf Management Empowerment, Efficiency and Development (UWMEED) Bill 2025 has been passed yesterday in Lok Sabha with 288 votes in favour and 232 against.  While the Waqf Amendment Bill introduced by the central government has curtailed some of the excessive powers granted to the Waqf Board, it still fails to fully safeguard the lands belonging to the Hindu community. The current Bill remains incomplete and lacks the necessary provisions to protect Hindu rights comprehensively. To rectify the historical injustices inflicted upon Hindu-owned lands, the government must seriously consider the recommendations put forth by Hindu representatives before the Joint Parliamentary Committee and take corrective measures, demanded the Hindu Janajagruti Samiti (HJS).

While Hindu  Hindu Janajagruti Samiti fully supports the removal of certain draconian provisions, including Sections 40, 104, 107, and 108 in the Waqf Amendment Bill, the organisation has raised its concern  through a press release on some dangerous aspects of the Bill, if takes into force with its various anti-Hindu pursuits . As per Section 3(c), only government-owned lands will be investigated, and details of previously designated Waqf properties will be collected. However, if lands belonging to Hindu temples, trusts, other communities, and the Archaeological Survey of India (ASI) have been unjustly classified as Waqf properties, they will not be subject to retrospective scrutiny. This means the Bill provides no assurance that such lands will be restored to the Hindu community.

Raised these concerns, National Spokespersons of HJS, Ramesh Shinde said, “further amendments to the Bill are necessary to ensure the complete protection of Hindu property rights. The Hindu community demands that: All lands previously designated as Waqf properties be thoroughly investigated. Illegitimate Waqf claims on Hindu temples, trusts, properties of other communities, and ASI-protected sites be immediately annulled. The special privileges granted to the Waqf Board be entirely revoked. The struggle for Hindu rights will continue, and the community must unite to raise its voice in defence of its lands.”

Hindutva activist and AOR (Advocate on Record) in the Supreme Court, Advocate Amita Sachdeva has also explained how the Hindu individual properties, temple lands and shrines will be affected with such incomplete Waqf Amendment Bill denying Hindu demands for protecting their property and religious rights. Actually in this amendment, there is no protection to the private properties of Hindus from the land grabs by Waqf board.

Former CBI  Director Questions On  Waqf Ammendment Bill

During the discussion of the Waqf Ammendment Bill 2025, Union Home Minister Amit Shah stated in Parliament, “from 1913 to 2013, the total land under the Waqf Board was 18 lakh acres. However, between 2013 and 2025, this land increased by 21 lakh acres, bringing the total to 39 lakh acres, with 21 lakh acres being added after 2013.”

Quoting the Union Home Minister, former CBI (Central Bureau of Investigation) Director. M Mageswar Rao has questioned about the intention of the Waqf Amendment Bill. In a tweet Rao said, “It is now abundantly clear that the #WaqfBillAmendment, is essentially intended to legalise the illegal transfer of 21 lakh acres of land to the Waqf.”

In another tweet, Rao raised his concern for the probable harassment of Hindus through false claims on their properties as Waqf, even after  the widely advertised Waqf Amendment Bill. The former CBI Director criticised the role of ‘#PseudoHindutva RSS-BJP-Modi Central Government’ for using ‘secular public funds’ to conduct survey of 77,000 acre Waqf land in Telangana intending ‘to protect alleged religious properties of Islam’.

Bharat witnessed the Lok Sabha debate on Waqf Amendment Bill. Barring only two dozen of Muslim MPs there, nearly 200 Hindu MPs in I.N.D.I. A block were advocating the draconian Waqf Act 1995 and opposing the Waqf Amendment Bill. Hindus sent these anti-Hindu MPs to cut the head the Hindus for their love for Islam, Sharia and Waqf.

Nobody has any concern whether the 1500 yrs old  Manadiyavalli Sametha Chandrasekhar Swamy Temple and the entire Tiruchenthurai village in Tamil Nadu will be freed after the enactment of Waqf Amendment Bill?

According to Waqf Amendment Bill in question, Waqf till date would be absolute either by user or by deed, where dispute is not pending. If Wakf by user is omitted then it should have retrospective effect,  which is not given in proposed bill. Now it is a big question, what is  the fate of  thousand acres of Hindu lands and properties which were illegally  encroached  by the Waqf Boards  in a hidden way across the country, the  victims  of which do not know even the enlistment of their lands and properties as Waqf!

In such a situation, if the Section 3(c) of the Waqf Amendment Bill does not cover the investigation for lands belonging to Hindu temples, trusts, other communities without fulfilling  other demands for various Hindu organisations presented to the Joint Parliamentary Committee on Waqf Bill; the culpable Waqf will reign over Hindus and other minorities through other loopholes. Legalise the illegalities in Waqf through the Amendment initiated by BJP  are not desirable anyway.
