Delhi Court Orders FIR Against Karishma Aziz Over Alleged Derogatory Remarks on PM Modi, Savarkar and Hinduism.

Upananda Brahmachari | HENB | New Delhi | Sept 19, 2026:: A Delhi court has directed the Delhi Police to register an FIR against social media user Karishma Aziz over posts and videos allegedly containing derogatory remarks concerning Hindu religious beliefs, historical figures and Prime Minister Narendra Modi.

Chief Judicial Magistrate (CJM) Mridul Gupta of the Patiala House Court issued the direction on Thursday, observing that the allegations made in the complaint disclosed the commission of cognisable offences warranting investigation.

“Accordingly, the application under Section 175(3) BNSS is allowed. SHO, Cyber Police Station, New Delhi, is directed to register an FIR on the basis of the complaint and undertake investigation in accordance with law,” the court ordered.

Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita (BNSS) empowers a magistrate to direct the police to register an FIR and investigate an alleged cognisable offence.

The order came while the court allowed a plea filed by advocate Amita Sachdeva, who has pursued legal action in several cases involving what she has described as attacks on Hindu sentiments, Hindu Dharma and Hindu deities. She has previously filed complaints against various individuals and authorities over allegedly anti-Hindu or anti-Sanatani content, including matters concerning Rana Ayyub, Dhruv Rathee, activists associated with the Cokroach Party and content circulated on YouTube.

Allegations in the Complaint

According to the complaint, Sachdeva came across several posts between February and April 2025 that allegedly contained objectionable remarks concerning Hinduism and prominent Hindu and national figures.

The complaint alleged that some of the posts mocked the spiritual views and disability of a Hindu saint, compared Prime Minister Narendra Modi to a dog, and made disparaging remarks about Hindu warriors and historical figures.

It further alleged that Aziz portrayed Mughal emperor Aurangzeb favourably while allegedly making derogatory references to Hindu icons. The complaint also accused her of describing Vinayak Damodar Savarkar as a “traitor” and making other remarks that, according to the complainant, targeted Hinduism and patriotic sentiments.

Delhi Police Response

In its response to the complaint, the Delhi Police stated that although some of the posts contained obscenity and targeted Hinduism, the material appeared to fall within the realm of political or historical commentary, criticism and satire.

The police further stated that its preliminary enquiry had not revealed evidence of a deliberate attempt to incite communal disharmony.

The court, however, said that while considering an application under Section 175(3) of the BNSS, it was not required to conclusively determine the truthfulness of the allegations or establish criminal liability at that stage.

Investigation Ordered

The court noted that the complainant had submitted screenshots, transcripts and links relating to a series of posts published over a period of time.

Whether the posts constituted protected political commentary, satire, criticism or historical opinion, or instead crossed the threshold into criminal conduct, would require investigation, the court observed.

The court also made it clear that its order directing registration of an FIR should not be interpreted as a finding that the allegations were proved.

Judge Gupta specifically stated that he had not expressed any opinion on the merits of the allegations.

The FIR and subsequent investigation will now determine the nature and context of the disputed posts and whether the allegations disclose offences under applicable law.
