Apologise or Face Defamation Trial: Supreme Court to Rahul in RSS-killed-Gandhi row.

Amit Yoginder | HENB | New Delhi | July 19, 2016:: The Supreme Court asked Congress vice-president Rahul Gandhi today  to express regret for his comments holding the Rashtriya Swayamsevak Sangh (RSS) was responsible for Mahatma Gandhi’s assassination or be ready to face a defamation trial.

“Why did you make a sweeping statement against the RSS branding everyone associated with the organization in the same brush,” the Supreme Court asked Rahul Gandhi while hearing a defamation case filed against Rahul.

” You can’t make wholesale denunciation of an organization,” the SC bench observed in a strict way of proceedings.

Giving time till July 27 to the 46-year-old Congress leader to file his side of the argument, the Supreme Court today said Rahul should either “apologise or face trial”.

“You must face trial, case must be decided on merits, whether what you spoke was for public good or not,” said a bench headed by Justice Dipak Misra.

The bench further observed that individuals can’t make wholesale denunciation of a organisation unless they can raise the defence of public good or truth.

The SC said that if Rahul Gandhi wanted to defend himself and was not ready to express his apology, than it will be better that he faced trial for sufficient ingredients lying in a case of defamation.

A bench of Justices Dipak Misra and R F Nariman refused Rahul’s request for two-week adjournment and fixed the matter for hearing on July 27.

Rahul Gandhi wanted two-week’s time saying his counsel Kapil Sibal is not free before that.

The SC said this is no ground for adjournment and posted the matter for July 27, saying no further postponement of hearing would be allowed anyway.

Rahul Gandhi had moved the Supreme Court in May 2015 for quashing the criminal case lodged against him for his comments against the RSS during a Thane rally in March 2014.

Actually, Mohandas Karamchand Gandhi was assassinated by Mahatma Nathuram Vinayak Godse (19 May 1910 – 15 November 1949) on 30 January 1948. Godse, a devoute Hindu Nationalist  shot Gandhi three times in the chest at point blank range outside of the Birla House in New Delhi. In his trial Godse pointed out many ‘malpractices’ done by Gandhi including these three:

 Gandhiji supported the idea of a separate State for Muslims from the backstage of Indian politics. In a sense he was responsible for the creation of Pakistan under the pressure of Jinnah and Nehru both.
In spite of the Pakistani aggression in Kashmir, Gandhiji fasted to compel the government of India to release an amount of Rs. 55 crores towards Pakistan.
The belligerence of Muslims and the growing fanaticism of Islam were the results of Gandhiji’s policy of appeasement.

RSS was banned by Govt after Gandhi’s assassination. However, investigators could find no evidence that the RSS bureaucracy had formally sponsored or even knew of Godse’s plot. The ban on the RSS was lifted in 1949. To this day it denies any connection with Godse and disputes the claim that he was a member.^{[See 1]} However, Godse’s brother Gopal Godse claims that all the Godse brothers were members of the RSS at the time of the assassination. According to Gopal Godse:

“All the brothers were in the RSS. Nathuram, Dattatreya, myself and Govind. You can say we grew up in the RSS rather than in our home. It was like a family to us. Nathuram had become a baudhik karyavah [intellectual worker] in the RSS. He has said in his statement that he left the RSS. He said it because Golwalkar and the RSS were in a lot of trouble after the murder of Gandhi. But he did not leave the RSS.”^{[See 2]}

Nathuram Godse was hanged to death in Ambala Jail on 15 November 1949. Crores of anti-Gandhi Indian think Nathuram Godse as a Hero and Gandhi as a villain for the plights on Hindus caused for the partition of India in 1947.
